Ordering Terms

These terms apply when you create an account or place an order on a restaurant's ordering site or app powered by Pulse (addresses ending in .order.pulse-pos.com, and the Pulse customer apps). Pulse is operated by Pulse POS Inc. ("Pulse"). By creating an account or ordering, you agree to these terms. How we handle your information is explained in our Privacy Policy.
Who you're buying from
The restaurant named on the ordering site sells you the food and other items, sets the menu and prices, prepares your order and is responsible for it. Pulse provides the ordering site and app, takes your payment for the restaurant through Stripe and sends your order updates. Pulse doesn't prepare, sell or deliver food.
Your account
- You sign in with your mobile number and a code we text you. Keep access to your phone and email secure; anyone who can read your codes can use your account.
- Give accurate details, including a phone number where the restaurant or courier can reach you about your order.
- You can delete your account at any time from your account page. See the Privacy Policy for what happens to your information.
Orders and prices
- Prices, taxes, fees and the total are shown before you pay. The total can include a service fee charged by Pulse, a delivery fee for delivery orders and any tip you choose. A tip on a pickup order goes to the restaurant; a tip on a delivery order goes to your courier.
- Your order is placed when your payment goes through and you see the confirmation. You'll get a receipt by email if you've given us your email address.
- The restaurant may decline or cancel an order, for example if an item has run out or it can't fill the order. You'll then be refunded in full.
- Pickup and delivery times are estimates. Scheduled orders are prepared for the time you choose, if the restaurant accepts it.
Allergies and dietary needs
Menus, descriptions, photos and allergen or dietary details come from the restaurant. Pulse doesn't check them. Restaurants prepare food in kitchens that may handle common allergens, so if you have an allergy or dietary requirement, contact the restaurant before ordering and say so in your order notes. Photos are for illustration and may not show exactly what you receive.
Delivery
Delivery orders are carried by couriers from Uber Direct. The courier may contact you using the phone number you give. Make sure your address and delivery notes are correct; if the courier can't reach you, the restaurant may not be able to refund the order. Some items, such as alcohol, can only be handed to someone of legal age with valid ID, where the restaurant offers them at all.
Cancellations and refunds
See our Refund and Cancellation Policy. In short: contact the restaurant about cancellations and problems with your order; refunds go back to how you paid.
Reward points, coupons and rewards cards
- Reward points and coupons are offered by the restaurant and can only be used at that restaurant. They have no cash value, can't be transferred or sold, and can't be exchanged for money.
- The restaurant sets and may change how points are earned and spent, and may end its program. Points earned on an order are removed if the order is cancelled or fully refunded, and points you spent on it come back.
- Points are removed if you delete your account, or if they were gained through fraud or misuse.
Messages
- Order messages (sign-in codes, confirmations, receipts and order updates) are part of the service. Message and data rates from your carrier may apply.
- The restaurant may send you news and offers by email, text or app notification where you've agreed or where the law allows it. You can turn each one off in your account, use the unsubscribe link in an email, or reply STOP to a text.
Using the service fairly
Don't place fake or fraudulent orders, misuse coupons or points, try to get into other people's accounts, interfere with the service, or use it for anything illegal. We or the restaurant may cancel orders and close accounts that do.
Liability
To the extent the law allows, Pulse isn't responsible for the food and items the restaurant provides, or for the restaurant's or courier's acts. Pulse's total liability to you for any claim about the ordering service is limited to the amount you paid for the order concerned. Nothing in these terms limits rights you have under consumer protection law that can't be limited.
Changes and contact
We may update these terms and will post the new version here with its effective date. These terms are governed by the laws of the province where you live in Canada, and the federal laws of Canada that apply there.
